1. About Joppa Africa
Joppa Africa (“Joppa”, “we”, “us” or “our”) is a discovery and connection platform that operates primarily through WhatsApp and the Joppa Africa website. Joppa helps people who need work done discover workers, tradespeople and contractors who have chosen to make their profiles available.
Joppa is a discovery and connection platform. It is not a job-management platform. Joppa’s role is to help users discover one another and make a direct connection. Once users connect, they communicate and make their own arrangements independently of Joppa.
2. Who may use Joppa
You must be at least 18 years old and legally capable of entering into agreements to register for and use Joppa. By registering, you confirm that the information you provide is truthful and that you are entitled to provide it.
3. User accounts and WhatsApp
Your WhatsApp number is used as a primary identifier for your Joppa account. You are responsible for access to your WhatsApp account, device and number. You must not impersonate another person, create misleading profiles, misuse another person’s information, or use Joppa for unlawful, fraudulent, abusive or harmful purposes.
WhatsApp is a third-party service. Joppa does not own or control WhatsApp and is not responsible for WhatsApp outages, account restrictions, delivery failures, policy changes or other acts or omissions of WhatsApp or its service providers.
4. Worker profiles
Workers may provide information including their name, profile photograph, skills, rates, availability, transport, tools and equipment, work photographs and an introduction video. Workers are responsible for ensuring that their profile information is accurate, lawful and not misleading.
Where Joppa records that identification documentation is “on record”, this means only that documentation has been supplied to Joppa. It does not mean that Joppa has verified, certified, vetted, endorsed or guaranteed the identity, qualifications, background, trustworthiness or suitability of that worker.
5. Search, location and availability
Joppa may use location information to help customers find workers near a selected job location. Search distance and other matching rules may be adjusted from time to time. Exact worker GPS coordinates are not intended to be displayed publicly to customers; Joppa may instead show relative distance or other proximity information.
A worker’s availability status is information supplied or selected by that worker. Joppa does not guarantee that a worker shown as available will remain available or accept any work.
6. Direct connection between customers and workers
When a customer chooses to contact a worker, Joppa may open or facilitate a direct WhatsApp conversation between them. Joppa may record that the connection occurred for platform operation, safety, ratings, analytics and related legitimate purposes.
After that connection, the customer and worker are responsible for their own communication and arrangements.
7. Joppa is not the employer, contractor or agent
Unless Joppa expressly agrees otherwise in writing, Joppa is not the employer or employee of any user; the customer, worker, contractor, subcontractor, labour broker, employment agency or representative in a job arranged between users; a party to the agreement between a customer and worker; or responsible for supervising, directing, managing or completing the work.
Users are responsible for determining the nature of their relationship and for complying with any laws, licences, registrations, tax, employment, health and safety, insurance or other obligations that apply to them.
8. Prices, quotes, payments and job arrangements
Rates displayed on worker profiles are supplied by workers and are informational. Customers and workers must agree directly on the scope of work, final price, materials, call-out charges, quotations, timing, transport, payment terms and any other conditions.
Joppa’s current service does not collect or hold payment for jobs, provide escrow, issue quotations on behalf of workers, manage bookings, confirm job completion, resolve payment disputes or guarantee payment.
9. No guarantee of work or results
Joppa does not guarantee that a worker will receive work, that a customer will find a suitable worker, that a user will respond to a message, or that any job or arrangement will proceed or be successful. Joppa does not guarantee the accuracy of user-supplied information, skills, experience, qualifications, rates, photographs, videos, availability, tools, transport, reviews or other profile content.
10. Ratings and reviews
Eligible customers may be able to rate or review a worker after a genuine Joppa connection. A rating reflects the opinion of the user who submitted it. It is not a certification, endorsement or finding by Joppa. Reviews must be honest and must not contain unlawful, threatening, discriminatory, defamatory, abusive, fraudulent or deliberately misleading content. Joppa may moderate or remove content where reasonably necessary.
11. Safety and user responsibility
Users must exercise reasonable judgment when dealing with people they meet through Joppa. Customers are responsible for deciding whether a worker is suitable for a particular task. Workers are responsible for deciding whether they are able and willing to perform requested work safely and lawfully. Users should agree important job details directly and obtain appropriately qualified persons where work requires specialist qualifications, licences or regulatory compliance.
12. Prohibited conduct
You may not use Joppa to commit or facilitate unlawful activity; harass, threaten or exploit another person; submit false or deceptive information; infringe intellectual property or privacy rights; upload malicious material; interfere with Joppa’s systems; scrape or harvest data without permission; manipulate ratings or referrals; or otherwise abuse the service.
13. Content you provide
You retain ownership of content you lawfully own. By uploading profile information, photographs, videos, reviews or other content to Joppa, you give Joppa a non-exclusive permission to store, process, reproduce, resize, transcode and display that content as reasonably necessary to operate, secure, improve and promote the Joppa service, subject to our Privacy Policy and applicable law. You must have the right to upload the content you provide.
14. Account suspension and removal
Joppa may restrict, suspend or terminate access, remove content, or prevent a profile from appearing in search where we reasonably believe this is necessary because of abuse, fraud, safety concerns, unlawful conduct, material breach of these Terms, technical/security risks or legal obligations.
15. Service availability and changes
Joppa may change, improve, suspend or discontinue features from time to time. We aim to provide a reliable service but do not guarantee uninterrupted or error-free availability. Internet, hosting, telecommunications, WhatsApp and other third-party failures may affect the service.
16. Liability
To the fullest extent permitted by applicable law, Joppa is not responsible for loss or damage arising from the acts or omissions of customers, workers or other users; work performed or not performed; injury or property damage arising from a job arranged independently between users; non-payment or payment disputes; inaccurate user information; or third-party services outside Joppa’s reasonable control.
Nothing in these Terms excludes or limits any right or liability that cannot lawfully be excluded or limited under South African law. Any limitation in these Terms must be interpreted subject to applicable consumer-protection and other mandatory laws.
17. Privacy
Joppa processes personal information as described in the Privacy Policy. By registering, you acknowledge that you have been given access to that Privacy Policy.
18. Electronic communications
You agree that Joppa may communicate with you electronically, including through WhatsApp and the website, for account operation, registration, service messages, safety, support and other lawful platform purposes. Marketing communications, where used, will be handled in accordance with applicable law and available opt-out rights.
19. Changes to these Terms
We may update these Terms when the service, law or our operating practices change. The current version and effective date will be published on the Joppa website. Where a change materially affects registered users, Joppa may provide additional notice or request renewed acceptance where appropriate.
20. Governing law
These Terms are governed by the laws of the Republic of South Africa. Nothing in these Terms prevents a user from exercising rights or approaching a regulator, court or other body where South African law gives that user such a right.
